Agatu Sues Federal Government Of Nigeria For N10BN Over Fulani Killings


The people of Agatu, Benue State, in the Middle Belt of Nigeria has filed a suit in the ECOWAS COURT in Abuja against the Federal Government of Nigeria for failing to protect the lives and protection of the Agatu people from Fulani terrorist marauders.



In an Originating application filed on their behalf by Barristers Adakole Edwin Inegedu and Albert Ade’Ejembi Egah, dated the 18th of July, 2016, the plaintiff  are seeking for the following reliefs :

A DECLARATION that the incessant killings, maiming of community citizens and the destruction of the properties of the inhabitants of the inhabitants of Agatu in Benue State by persons referred to as Fulani herdsmen; and the inaction of the Federal Government in restraining them, constitutes a breach of the fundamental rights of the people of Agatu as guaranteed by the requisite Articles of the African Charter On Human and Peoples’ Rights and of the Universal Declaration of Human Rights.
A DECLARATION that the deliberate inaction fo the Federal Government in its refusal to recognise and protect the rights of the Agatu people and other victims of the incessant killings, maiming and the destruction of properties by Fulani herdsmen in Agatu, constitutes a breach of the Fundamental Rights of the People of Agatu as guaranteed under the African Charter On Human and People’s Rights and the Universal Declaration of Human Rights.
AN ORDER directing or compelling the Federal Government of Nigeria to immediate take legislative, administrative, and judicial measure to recognise, promote, and protect the rights of Agatu people from further breach of their rights by the Fulani herdsmen or any other group of citizens.
AN ORDER  directing the Federal Government to pay the sum of Ten Billion Naira as adequate compensation to the Agatu people for the deaths, injuries, and destruction of properties due to the inaction of the Federal Government in preventing the gross violation of the right of the Agatu people by Fulani herdsmen or any other citizens.
AN ORDER directing the Federal Government to resettle, rebuild and rehabilate all surviving victims of the Agatu communities; and to provide basice amenities in the destroyed communities in accordance with the provisions of the African Charter of Human  and People’s Rigts and other revelant international instruments.
The matter is yet to be assigned.
